DWI in North Carolina or driving while impaired in North Carolina is technically a misdemeanor. It’s important to point out a few different issues involved with that. DWI’s are sentenced differently than misdemeanors. DWI’s have different procedural protocols and the way we do things in court are differently with DWI’s. DWI’s in North Carolina are not felonies unless you have a series of convictions of DWI. Then you can have a habitual DWI. In the simplest terms a DWI is closer to a misdemeanor than almost anything else.
